This Privacy Policy describes how Amphastar Pharmaceuticals, Inc., including its subsidiaries and its affiliates, (collectively, "Amphastar") handles the personal information that you provide to us on our Web Sites, such as www.amphastar.com or www.primatene.com (collectively, "Web Sites"). It does not apply to the information collected from you in other forums, including offline information collection. We understand the importance of privacy to our customers and visitors to our Web Sites. This Privacy Policy outlines what data we may collect about you and how we may use it. Please be sure to read this Privacy Policy before using or submitting information to us. This Privacy Policy is subject to change from time to time, so please check this Privacy Policy periodically. Handling of Your Information

Amphastar provides you the opportunity to contact us regarding questions you may have about Amphastar or its products. As part of that process, Amphastar collects personal identifying information such as customer name, street or email address, phone number, or any other information which when used by itself or with other data might identify a customer or visitor to our Web Sites. To protect your safety, you should not provide Amphastar with any personal information that is not specifically requested, including but not limited to your personal medical history. We may use the information you provide to respond to any question you have asked. Personal identifying information is used only for legitimate business interests, including complying with applicable laws and regulations.

Tracking Technology ("Tools")

Amphastar collects information about you by using cookies, tracking pixels and other technologies (collectively, "Tools"). We use this information to better understand, customize and improve user experience with our Web Sites, product offerings, and manage our advertising. For example, we may use web analytics services that leverage these Tools to help us to better understand how visitors engage with and navigate our Web Sites, e.g., how and when pages in our Web Sites are visited and by how many visitors. We are also able to offer our visitors a more customized, relevant experience on our Web Sites using these Tools by delivering content and functionality based on your preferences and interests. If we have collected your personal data, e.g., through a registration or a request for certain materials, we may associate this personal data with information gathered through the Tools. A cookie is a text file containing information about a user that is stored on a user's device or computer hard drive. Cookies are used for a variety of purposes, including helping you log into parts of our Web Sites, to enable us to track the interests of our users to enhance their experience on our Web Sites, for market research purposes, and to deliver content specific to a user’s interests. Certain information is collected by most web browsers or automatically through your device, such as your Media Access Control (MAC) address, computer type (Windows or Macintosh), screen resolution, operating system name and version, device manufacturer and model, language and Internet browser type and version. We use this information to ensure that the services function properly.

We may also use Internet Tags such as "pixel tags," also known as "web beacons," which are small graphic files that allow us to monitor the use of our Web Sites. A pixel tag can collect information such as the IP (Internet Protocol) address of the computer that downloaded the page on which the tag appears; the URL of the page on which the pixel tag appears; the time the page containing the pixel tag was viewed; the type of browser that fetched the pixel tag; and the identification number of any cookie on the computer previously placed by that server. When corresponding with you via HTML capable email, we may use "format sensing" technology, which allows pixel tags to let us know whether you received and opened our email.

Your IP address is a number that is automatically assigned to the computer that you are using by your Internet Service Provider. An IP address may be identified and logged automatically in our server log files whenever a user accesses the Web Sites, along with the time of the visit and the pages visited. Collecting IP addresses is standard practice and is done automatically by many websites, applications and other services. We use IP addresses for purposes such as calculating usage levels, diagnosing server problems and administering the Web Sites. We may also derive your approximate location from your IP address.

We may use Google Analytics, which uses cookies and similar technologies to collect and analyze information about use of the Web Sites and report on activities and trends. This service may also collect information regarding the use of other third party websites, apps and online resources. We may use Flash Local Shared Objects ("Flash LSOs") and other technologies to, among other things, collect and store information about your use of the Web Sites. If you do not want Flash LSOs stored on your computer, you can adjust the settings of your Flash player to block Flash LSO storage using the tools contained in the Website Storage Settings Panel. You can also control Flash LSOs by going to the Global Storage Settings Panel and following the instructions (which may include instructions that explain, for example, how to delete existing Flash LSOs (referred to as “information” on the Macromedia site), how to prevent Flash LSOs from being placed on your computer without your being asked, and (for Flash Player 8 and later) how to block Flash LSOs that are not being delivered by the operator of the page you are on at the time). Please note that setting the Flash Player to restrict or limit acceptance of Flash LSOs may reduce or impede the functionality of some Flash applications, including those used in connection with the Web Sites.

Internet-Based Advertising

Amphastar hopes to deliver to you advertising for products you need or want. There are many ways to do this in the online advertising world. For example, Amphastar partners with websites and applications with whom you have shared your interests, conditions and concerns directly and asks that they serve our ads to users who have expressed an interest in Amphastar products or health conditions or symptoms that our products may treat or provide temporary relief. We may also partner with advertising companies that may place or recognize a unique cookie on your browser (including through the use of pixel tags), or use other technologies, to serve you ads based on your web browsing activity, purchases, interests and/or other information—a practice commonly referred to as interest-based advertising ("IBA") or online behavioral advertising ("OBA"). These advertising companies may also use these types of technologies to recognize you across the devices you use, such as a mobile phone or a laptop, and serve you ads on websites you visit and applications you use. Amphastar desires it to be easy for you to understand how we and our business partners use information to serve ads tailored for you and to opt-out from targeting based on IBA. Health Insurance Portability and Accountability Act ("HIPAA")

Amphastar is not a "covered entity" subject to the Health Insurance Portability and Accountability Act ("HIPAA"). Moreover, Amphastar does not request or collect any medical information subject to HIPAA on our Web Sites. You further agree not to send Amphastar, via our Web Sites, any medical information subject to HIPAA. To the extent that you voluntarily provide Amphastar with medical information subject to HIPAA, then you do so at your own risk because Amphastar cannot guarantee absolute security of such medical information.

The Privacy of Children

We understand the need to protect children's privacy online (we define "children" as minors younger than 13 years old). We do not knowingly collect or use any personal information from children. We do not knowingly allow children to register with us, order our products, communicate with us, or to use any of our online services.

Contacting Amphastar

You may, at any time, remove your personal identifying information from our current customer database. If you have submitted personal identifying information to Amphastar, and you wish to have it removed from our records, please email us at Info@Amphastar.com.

To process your request, you must include the Web Sites to which you provided the information (e.g., www.Amphastar.com, www.primatene.com, etc.) and indicate on the subject line “Deletion Request.” However, for our record keeping purposes, we will retain personal identifying information that you submitted for any previously completed contractual transactions. Security

Amphastar is committed to providing reasonable measures to protect your personal identifying information from any unauthorized access or disclosure. However, despite our measures to secure your information, we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your personal information. In addition to the steps taken by Amphastar to protect your information, you should also take measures to safeguard your personal information and your privacy.

Collection of Personal Information By Third Parties

Some links on our Web Sites may redirect you to third party websites that we do not operate. The privacy practices of these websites will be governed by their own policies. We make no representation or warranty as to the privacy policies of any third parties, including the providers of third party applications. If you are submitting information to any such third party through our Web Site, you should review and understand that party’s applicable policies, including their privacy policy, before providing your information to the third party.

Visitors That Reside Outside the United States

Amphastar provides its Web Sites for the purpose of serving interested parties within the United States. The laws governing the collection and use of information within the United States may be different from the laws of your country. If you decide to use our Web Sites, or share your personal information with Amphastar, you are agreeing to be governed by the laws of the United States as appropriate, and you are expressly consenting to the transfer of your data to the United States.
